
Sia’s estranged husband, Dan Bernad, has been denied sole custody of their 1-year-old son, Somersault “Summi,” after a contentious legal battle.
A Los Angeles County judge denied Bernad’s request and ordered that the couple adhere to their previous custody agreement on Wednesday, citing insufficient evidence as the reason for its decision.
“The court finds that sufficient exigency for the requested emergency relief has not been shown at this time,” the court docs obtained by Page Six read.
“The parties entered into a stipulated legal custody and interim physical custody arrangement on August 1, 2025. Most of the facts asserted in Respondent’s RFO were known at that time.”
Reps for Sia and Bernad did not immediately respond to Page Six’s requests for comment.
Bernad requested sole custody of Summi, telling the court in his Monday filing that he is the “only safe and reliable parent” for their son as he claimed Sia, 49, is a “serious and immediate danger” to the toddler.
“Sia is an unfit and unreliable parent struggling with substance abuse and addiction, rendering her incapable of providing safe or stable care for Summi,” Bernad, an oncologist, alleged.
“I am a doctor, young, healthy and have no criminal history or drug or alcohol addiction issues,” he wrote.
Bernad went on to allege that the “Chandelier” hitmaker purposefully hid her recent two-week hospitalization in Los Angeles last month after she tested positive for barbiturates and benzodiazepines, with no credible medical explanation.
In addition to his request for sole custody, he also asked that his estranged wife be subjected to random and regular drug testing, and limited to two-hour professionally monitored visits with Summi, three times a week.
Sia — who admitted to struggling with substance abuse 15 years ago — called Bernad’s allegations an “attempt to weaponize” her sobriety in her response, and claimed she’s been sober for six months.
She also added that she’s repeatedly agreed to routine drug screenings for both parents in the past, but it was Bernad who didn’t follow through with testing.
Sia has maintained full custody of Summi since she filed for divorce from Bernad in March after two years of marriage.
But, she claimed the two agreed in August that Bernad would have limited professionally monitored visitation with their son as the oncologist was allegedly under investigation by the Los Angeles Police Department and the Department of Children and Family Services for “illicit child pornography” found on his computer hard drive.
According to a declaration submitted by Sia in the case, the result of the investigation was allegedly inconclusive, and the case was therefore closed.
Bernad denied his involvement with child pornography and, instead, accused his estranged wife of planting evidence to restrict his custody rights.
