
Kim Zolciak clarified her custody battle issues after it was reported that she’s not allowed to see her and Kroy Biermann’s kids again until she completes therapy.
On Friday, the reality star explained in a lengthy Instagram Story that she had “not lost custody” of her children — Kroy Jr., 14, Kash, 13, and 12-year-old twins Kaia and Kane — “nor has there been any modification to the custody arrangement.”
“I signed a temporary custody order at the end of January,” Zolciak continued. “The order clearly states that both the mother and father are to participate in two counseling sessions per month for two months, followed by one session per month thereafter. I was out of the country from February 26 through March 28 due to contractual filming obligations on two separate productions.”
The “Real Housewives of Atlanta” alum added that she did not have any days off to attend the counseling sessions.
“Kroy as of today (I had KJ and Kash up until 5pm today) currently has the children for spring break, which is his designated parenting time under the existing agreement,” Zolciak, 47, revealed. “I am scheduled to resume my parenting time when the children return on Friday. My counseling sessions are scheduled and will be completed next week.”
Before logging off, the mom of six made it clear that she had not been stripped of her parenting rights.
“For the avoidance of any doubt,” she wrote, “I have not lost custody of my children, nor has there been any modification to the custody arrangement outside the agreed upon temporary order.”
Zolciak also re-posted TMZ’s original reporting, writing beneath the picture: “I will absolutley not put up with these lies any longer.”
Zolciak’s Friday statement comes on the heels of TMZ obtaining court records earlier in the day that said the exes’ four minor children would reside with Biermann, 40, from April 3 until the Bravo star completed four mandatory parent therapy sessions.
According to the court order, the earliest Zolciak could be reunited with her kids is April 13.
Just a few days prior, Biermann requested sole custody of the pair’s children over his ex’s alleged “mismanagement of basic parenting responsibilities.”
The retired athlete asked a judge to amend their joint custody arrangement, according to court records obtained by TMZ on Monday.
Biermann also claimed the “Tardy for the Party” singer has been out of the country for weeks, per the outlet.
He reportedly insisted that “the facts surrounding [Zolciak’s] misguided parenting of the children, lack thereof, and blatant mismanagement of basic parenting responsibilities would be practically unbelievable to anyone not familiar with the circumstances.”
Biermann then accused the reality star of committing “fraud and deceit” when they agreed upon their current joint custody arrangement and alleged that Zolciak only used her parenting time once between Feb. 26 and March 29.
According to the former NFL star’s complaint, one of their kids was bitten by a dog while in Zolciak’s care on March 9.
In a statement to Page Six, the “Surreal Life” alum slammed her ex’s request, telling us, “These accusations are completely false and nothing more than a deliberate attempt by Kroy to defame my character. I spent five weeks away working on two TV shows to support my family and make sure my children are cared for — something I will never apologize for.”
She added, “I refuse to be bullied or have lies twisted into a narrative about who I am. I will not stay silent; the truth is on my side, and it will come to light—no matter how hard anyone tries to bury it.”
Meanwhile, Zolciak and Biermann’s messy court battle first started two years prior, with the linebacker filing for sole custody of their kids in August 2025.
Biermann reportedly accused Zolciak of subjecting their children to “emotional and psychological abuse” in that filing, and claimed that his ex repeatedly left them alone without “proper parental guidance.”
The former flames first filed for divorce in May 2023 following 11 years of marriage.
Despite a brief rekindling, Biermann — who also adopted Zolciak’s two daughters from a previous relationship: Brielle, 29, and Ariana, 24 — refiled in August 2023.
Although Zolciak and Biermann were still living together in their Georgia mansion after their 2023 split, the duo was forced to move out of the foreclosed property by US Marshals in April 2025.
